Return & Refund Policy – Marché Noir

This Return & Refund Policy applies to all purchases made through the Shopify webshop of Marché Noir, based in Belgium. This policy complies with applicable Belgian and EU consumer protection laws and is designed to clearly define the rights and obligations of both the customer and Marché Noir.

By placing an order, the customer agrees to this Return & Refund Policy.

1. Right of Withdrawal (EU Consumers)

In accordance with Belgian and EU consumer law, customers have the right to withdraw from their purchase within 14 calendar days without providing any reason.

  • The withdrawal period expires 14 days after the day the customer (or a third party designated by the customer) receives the goods.

  • To exercise the right of withdrawal, the customer must notify Marché Noir in writing (e.g. by email) within this 14-day period.

2. Conditions for Returns

Returned items must meet all of the following conditions:

  • The item must be returned within 14 days after the withdrawal notification.

  • The item must be in the same condition as received.

  • The item must not be worn beyond fitting, washed, altered, or damaged.

  • Original tags, labels, and any packaging (if applicable) must still be attached.

Marché Noir reserves the right to refuse returns or reduce the refund if the returned item shows signs of use, damage, or handling beyond what is necessary to assess the nature, characteristics, and functioning of the item.

3. Second-Hand Clothing Disclaimer

  • All items sold by Marché Noir are second-hand.

  • Minor signs of wear, imperfections, or aging are inherent to second-hand items and are not considered defects.

  • Returns will not be accepted based on characteristics clearly visible or described on the product page.

4. Refunds

If a return is approved:

  • Marché Noir will refund the purchase price of the item.

  • The standard outbound shipping costs (the cheapest shipping option offered) will be refunded in accordance with EU law.

Refunds will be processed within 14 days of receiving the withdrawal notification. Marché Noir may withhold the refund until the returned item has been received or until the customer provides proof of return.

Refunds will be issued using the same payment method used for the original transaction, unless expressly agreed otherwise.

5. Return Shipping Costs

  • Return shipping costs are entirely the responsibility of the customer.

  • Marché Noir does not provide prepaid return labels.

  • Shipping costs are non-refundable.

6. Reduced or Refused Refunds

Marché Noir reserves the right to partially or fully refuse a refund in the following cases:

  • The item has been worn, washed, altered, or damaged.

  • Tags or labels have been removed.

  • The item is returned incomplete or in an unsanitary condition.

  • The return does not comply with the conditions outlined in this policy.

Any reduction in refund will be proportionate to the loss in value of the item, as permitted by EU consumer law.

7. Non-Returnable Situations

Returns will not be accepted if:

  • The withdrawal period of 14 days has expired.

  • The customer fails to notify Marché Noir of the withdrawal within the legal timeframe.

  • The item does not meet the return conditions stated above.

8. Exchanges

  • Marché Noir does not offer direct exchanges.

  • Customers wishing to obtain a different item must place a new order.

9. Incorrect Items or Shipping Errors

If the customer receives an incorrect item due to an error by Marché Noir, the customer must contact us within 48 hours of delivery with clear photographic evidence.

In such cases, Marché Noir will provide appropriate instructions and cover reasonable return shipping costs.
